I. OBJECT

The Poppers Aromas loyalty program (hereinafter “Poppers Aromas Loyalty” and/or ”the Poppers Aromas Loyalty Program") is a program provided and managed by Black Sequoia SAS, whose registered office is located at 1 rue de Belle-Île, 35760 Saint-Grégoire, France, registered with the Rennes Trade and Companies Register under number 805 112 042.

This Loyalty Program allows you to earn points based on purchases made on the website www.poppers-aromas.eu, entitling you to benefits and/or exclusive offers.

The “Poppers Aromas Loyalty” has three levels:

  • BRONZE
  • SILVER
  • GOLD

The purpose of these terms and conditions is to define the operational methods of the “Poppers Aromas Loyalty” loyalty program (hereinafter the “Terms and Conditions”).

Membership in the “Poppers Aromas Loyalty” implies unconditional acceptance of these Terms and Conditions.

 

II. SUBSCRIPTION TO THE POPPERS AROMAS LOYALTY PROGRAM

 

A. AELIGIBILITY TO THE POPPERS AROMAS LOYALTY PROGRAM

The Poppers Aromas Loyalty Program is open to legally competent individuals (persons aged 18 or over on the date of their registration in the Loyalty Program and not subject to any legal incapacity).

Black Sequoia reserves the right to request at any time any document proving the identity of the person wishing to subscribe or having subscribed to the Poppers Aromas Loyalty Program, particularly in the event of homonymy.

 

B. CONDITIONS OF REGISTRATION TO POPPERS AROMAS LOYALTY PROGRAM

Registration for the “Poppers Aromas Loyalty” is free of charge.

When joining the “Poppers Aromas Loyalty”, members are asked to provide certain information (such as their full name, email address, postal address, and date of birth) by completing the online form available on the website www.poppers-aromas.eu. This information is processed in accordance with Article 5. “Personal Data” of these Terms and Conditions.

Once the registration form has been completed, registration for the “Poppers Aromas Loyalty” is confirmed by a welcome message sent to the email address provided by the member during registration, subject to the above conditions.

Membership in the “Poppers Aromas Loyalty” is only valid and registered if the information provided at the time of registration is complete, accurate, in the required format, and usable. It is the member's responsibility to keep their information up to date by making the necessary updates on the website www.poppers-aromas.eu. Black Sequoia cannot be held responsible for any member of the Loyalty Program not receiving an offer due to outdated or incorrect information.

Once you have joined the “Poppers Aromas Loyalty” in accordance with the above instructions, you will become a member of the Loyalty Program (hereinafter referred to as the “Member(s)”).

 

C. STATUSES ASSOCIATED WITH POPPERS AROMAS LOYALTY PROGRAM



i. CONDITIONS FOR OBTAINING BRONZE STATUS

The “BRONZE” status corresponds to the first level of the Poppers Aromas Loyalty Program. It is subject to a purchase obligation, starting with the first purchase to obtain 1 point.

Consequently, it is expressly stated that if a member wishes to register for the Loyalty Program and obtain Member status without purchasing any products, no points will be credited to the account at the time of registration validation.

In any event, “BRONZE” status applies from 1 point up to 139 points earned over a period of 365 days, with points being earned under the conditions defined in Article IV “BENEFITS OF THE POPPERS AROMAS LOYALTY PROGRAM” of these Terms and Conditions.

Black Sequoia reserves the right to modify the conditions for obtaining BRONZE status at any time.

 

ii.CONDITIONS FOR OBTAINING SILVER STATUS

A member of the Poppers Aromas Loyalty Program receives “SILVER” status when they have earned 140 points. SILVER status is valid for a period of 365 days after eligibility. After these 365 days, if the member does not have the required number of points, 140 points, to maintain their SILVER status, they will be downgraded to BRONZE status.

In any case, SILVER status applies up to 279 points accumulated over a period of 365 days, with points being earned under the conditions defined in Article IV “BENEFITS OF THE POPPERS AROMAS LOYALTY PROGRAM” of these Terms and Conditions.

Black Sequoia reserves the right to modify the conditions for obtaining SILVER status at any time. 

 

iii. CONDITIONS FOR OBTAINING GOLD STATUS

A member of the Poppers Aromas Loyalty Program receives “GOLD” status when they have earned 280 points. GOLD status is valid for a period of 365 days after eligibility. After these 365 days, if the member does not have the required number of points (280) to maintain their GOLD status, they will be downgraded to BRONZE status if they have fewer than 140 points, or SILVER status if they have more than 140 points but fewer than 279 points.

In any case, GOLD status applies from 280 points accumulated over a period of 365 days, with points being obtained under the conditions defined in Article IV “BENEFITS OF THE POPPERS AROMAS LOYALTY PROGRAM” of these Terms and Conditions.

Black Sequoia reserves the right to modify the conditions for obtaining GOLD status at any time.

 

III. TERMS AND CONDITIONS OF USE OF THE LOYALTY PROGRAM

The accounts of members of the “Poppers Aromas Loyalty” are strictly nominative, personal and reserved for individuals for their own non-professional use. They cannot be transferred.

There can only be one account per person (same last name, first name, address, email, and/or phone number). Black Sequoia reserves the right to carry out any checks it deems appropriate to verify the validity of the Loyalty Program subscription and/or the use of points associated with the account. If Black Sequoia finds that the same person has multiple accounts within Poppers Aromas Loyalty, the member's data and benefits will only be counted once within a single account, and the redundant accounts will be deactivated, deleted, and purged of their points and benefits. It is specified that Members may access their customer account on the website www.poppers-aromas.eu at any time to update their personal information.

The Member agrees to use Poppers Aromas Loyalty in accordance with the provisions of these Terms and Conditions. Failure to do so will result in Black Sequoia reserving the right to suspend or terminate the Member's loyalty account, deactivate it, or remove their points, under the conditions set out in Article VI “Suspension/Deactivation/Loss of Points” herein.

Upon joining the “Poppers Aromas Loyalty”, each member declares and guarantees that they meet the eligibility criteria and accept these Terms and Conditions, it being understood that these Terms and Conditions may be updated by Black Sequoia at its sole discretion, in accordance with the terms defined herein.

 

IV. BENEFITS OF THE POPPERS AROMAS LOYALTY PROGRAM

A. RULES GOVERNING THE USE OF POINTS AND APPLICABLE TO ALL MEMBERS

i. GENERAL PRINCIPLES

Accumulated points cannot be transferred or exchanged for their cash equivalent. If the right of withdrawal is exercised following an order placed on the website www.poppers-aromas.eu, Black Sequoia will deduct from the total number of points accumulated on the Member's Poppers Aromas Loyalty account the number of points accumulated through the purchase of the product(s) for which a refund is requested and, where applicable, reserves the right to temporarily suspend the account of the Member concerned to carry out any checks it deems necessary to ensure that this is not a case of fraud. In this regard, and if fraud is proven, Black Sequoia may permanently close the account, without the Member being entitled to claim the benefits to which the points available on their account gave them access, or to the payment of any indemnity or compensation whatsoever. In such cases, Black Sequoia will notify the Member by any appropriate means.

Members can check their points through various channels:

  • On the website www.poppers-aromas.eu in the “Loyalty Account” section (once the Member has created an account on the website).
  • By phone, contacting Customer Service at the following number: +44 20 3445 5897 (no surcharge, cost of a normal call with your operator)

 

ii. POINTS ACCOUNTING

Every euro (€1) spent (excluding delivery costs) when purchasing products on the website www.poppers-aromas.eu generates one point on the Member's account.

For any purchase of products under the above conditions where the total amount (excluding delivery costs) ends in a decimal point, the amount is rounded up to determine the number of points accumulated.

Example: if the total purchase amount is €36.30 including tax, the member will accumulate 37 points. If the total purchase amount is €56.75 including tax, the member will accumulate 57 points.

 

iii. COMMON RULES, REGARDLESS OF STATUS

- Loyalty vouchers

All members of the loyalty program can convert their accumulated points into loyalty vouchers of their chosen value. These vouchers are non-transferable and valid for 90 days from the date of issue. Loyalty vouchers cannot be used to reduce your purchase to less than €0. Therefore, the minimum purchase amount on the website www.poppers-aromas.eu must be €0. 

Loyalty vouchers cannot be combined with any other commercial offer in effect at the time of use, nor can they be combined with each other (unless otherwise specified in the commercial offer).

- Referral 

Any Member of the loyalty program may refer a friend or family member using a link available in their loyalty account. Members who refer others earn additional loyalty points. Referred Members receive a welcome gift upon joining the loyalty program, valid for 30 days from the date of registration.

 

B. BENEFITS ASSOCIATED WITH “BRONZE” STATUS

The “BRONZE” status gives you access to the following benefits:

- Birthday gift

All Poppers Aromas Loyalty Members will receive a birthday gift, valid for 30 days from the member's birthday, for any purchase made on www.poppers-aromas.eu.

The offer is valid for one birthday gift every 365 days.

- Status gift

All Poppers Aromas Loyalty Members will receive a gift when they achieve a new status, valid for 90 days from the date of the new status.

- Exclusive point offers

Black Sequoia reserves the right to create specific offers for Members allowing them to accumulate more points over a given period and up to a maximum number of points. 

The terms and conditions associated with these offers will be defined by Black Sequoia when each offer is set up and communicated to Members prior to the start of each offer. Said communication will be carried out by Black Sequoia by any appropriate means and in compliance with the regulations in force, particularly with regard to the protection of personal data.

C. BENEFITS ASSOCIATED WITH “SILVER” STATUS

The “SILVER” status gives you access to the following benefits:

- Birthday gift

All Poppers Aromas Loyalty Members will receive a birthday gift, valid for 30 days from the member's birthday, for any purchase made on www.poppers-aromas.eu.

The offer is valid for one birthday gift every 365 days.

- Status gift

All Poppers Aromas Loyalty Members will receive a gift when they achieve a new status, valid for 90 days from the date of the new status.

Black Sequoia reserves the right to create specific offers for Members allowing them to accumulate more points over a given period and up to a maximum number of points. 

The terms and conditions associated with these offers will be defined by Black Sequoia when each offer is set up and communicated to Members prior to the start of each offer. Said communication will be carried out by Black Sequoia by any appropriate means and in compliance with the regulations in force, particularly with regard to the protection of personal data.

- Permanent discount

Each SILVER Member will receive a 5% discount on all products on the website www.poppers-aromas.eu. The discount is automatically applied to products and does not require any action on the part of the Member. 

D. BENEFITS ASSOCIATED WITH “GOLD” STATUS

The “GOLD” status gives you access to the following benefits:

- Birthday gift

All Bronze Poppers Aromas Loyalty Members will receive a birthday gift, valid for 30 days from the member's birthday, for any purchase made on www.poppers-aromas.eu.

The offer is valid for one birthday gift every 365 days.

- Status gift

All Poppers Aromas Loyalty Members will receive a gift when they achieve a new status, valid for 90 days from the date of the new status.

- Exclusive point offers

Black Sequoia reserves the right to create specific offers for Members allowing them to accumulate more points over a given period and up to a maximum number of points. 

The terms and conditions associated with these offers will be defined by Black Sequoia when each offer is set up and communicated to Members prior to the start of each offer. Said communication will be carried out by Black Sequoia by any appropriate means and in compliance with the regulations in force, particularly with regard to the protection of personal data.

- Permanent discount

Each GOLD Member will receive a 10% discount on all products on the website www.poppers-aromas.eu. The discount is automatically applied to products and does not require any action on the part of the Member. 

 

V. PERSONAL DATA

Black Sequoia may collect personal data about you when you participate in the Loyalty Program.

VI. SUSPENSION / DEACTIVATION / LOSS OF POINTS

Black Sequoia reserves the right to suspend, deactivate, or withdraw points, without the Member being entitled to claim compensation, in the following cases:

  • Fraud, attempted fraud, and/or theft on the part of the Member
  • Abnormal volume of orders on the website www.poppers-aromas.eu 
  • Payment incident 
  • Failure to comply with the rules set out in these General Terms and Conditions of the Poppers Aromas Loyalty Program

In the event of account suspension, the Member's points and benefits will be retained for the duration of their validity.

In the event of account deletion, the Member's points and benefits will be permanently deleted.

  

VII. MODIFICATIONS TO THE GENERAL TERMS AND CONDITIONS OF THE LOYALTY PROGRAM

Black Sequoia reserves the right to modify the “Poppers Aromas Loyalty” Loyalty Program and/or these Terms and Conditions at any time, in particular to comply with any new applicable legislation and/or regulations, and/or to improve the Loyalty Program. Any modifications will be incorporated into these Terms and Conditions.

The applicable Terms and Conditions of Poppers Aromas loyalty program are those available on the website www.poppers-aromas.eu. Black Sequoia, therefore invites members to regularly consult the website www.poppers-aromas.eu.

Black Sequoia reserves the right to suspend or terminate the Program, particularly if circumstances so require. In such cases, members shall not be entitled to claim any compensation whatsoever in this regard. Black Sequoia shall make every effort to inform Loyalty Program members of the suspension or termination of the “Poppers Aromas Loyalty Program” as soon as possible and by all appropriate means.

In the event of the permanent discontinuation of Poppers Aromas Loyalty or a complete overhaul of the program resulting in the loss of valid offers and/or accumulated points, members will be notified by any appropriate means (mail, email, text message).

 

VIII. RESPONSIBILITY

Black Sequoia is not responsible for any direct or indirect consequences or problems related to the Poppers Aromas loyalty program. However, Black Sequoia will make every effort in the event of a malfunction to ensure that the program member retains the benefits and rights applicable under the loyalty program.

If Black Sequoia wrongfully denies points to a Member, Black Sequoia's liability shall be limited to the number of points wrongfully not awarded and/or withdrawn.

IX. MISCELLANEOUS PROVISIONS

If one or more provisions of these Terms and Conditions are deemed unlawful or void, this shall not affect the validity of the remaining provisions of the Terms and Conditions.

These Terms and Conditions are subject to French law.

Any dispute that may arise from the interpretation and/or execution of these Terms and Conditions, and more generally from the Poppers Aromas loyalty program, shall fall under the jurisdiction of the courts designated in accordance with the Code of Civil Procedure.
